任何人都有追求利益的權利，但若以不法手段追求利益即是犯罪。當犯罪者在自身的國家中已經無法得到更多的利益，轉往他國從事得到更多利益的不法行為，似乎也是預料之中的變化。在全球化的影響之下，組織犯罪已經不再受到傳統國界的限制，而是成為跨國性的問題。台灣近年來經濟穩定成長，除了是各國商業投資的重要市場，亦可能成外籍組織犯罪集團鎖定的目標。文獻探討先針對組織犯罪定義及其集團架構演變進行論述，發現組織犯罪已朝著網絡化的方向發展。接著透過觀察外籍人士在台犯罪數據，搭配社會控制理論及文化衝突理論，初步描繪出外籍人士在台犯罪的概況。再蒐集組織犯罪跨國移動現象等相關研究，輔以日常活動理論、理性選擇理論與犯罪型態

理論等犯罪理論，闡述環境、人口等因素對組織犯罪集團選擇犯罪地點之影響。最後運用犯罪腳本分析，討論犯罪網絡的接觸、參與或是犯罪者的生活型態與組織犯罪集團跨國犯罪的互動關係。針對2020年我國各地方法院第一審判決書進行分析，歸納出外籍組織犯罪集團在台犯罪型態。本研究發現外籍組織犯罪集團分別以國外移入及在地發展兩種方式，在台灣從事犯罪活動。犯罪的成員多以失聯的外籍移工為主，或是利用免簽證或合法簽證入境台灣。犯罪類型包括森林法、銀行法、毒品危害防制條例、刑法詐欺罪及剝奪他人行動自由或暴力犯罪等案類。受到組織犯罪網絡化的影響，外籍組織犯罪集團在犯罪網絡中大多是擔任最底層的角色，不僅容易遭到緝獲，還因為其

身份、生活型態、跨國犯罪的特性，成為追查犯罪網絡的斷點，阻撓執法機關持續向上溯源的機會，使此類型的犯罪反覆發生。最後以情境犯罪預防的五項策略，搭配相關犯罪理論，提出外籍組織犯罪集團在台犯罪預防措施建議如下：外籍組織犯罪集團納入警政統計分析、加強管理外籍移工人頭門號、落實稽查外籍移工易聚集處所、提升社會約制功能、網路通訊服務實施通訊監察、積極查緝失聯移工、強化非法物品銷售通路查察、提供外籍移工專屬匯兌管道、針對洗錢犯罪加強查緝、犯罪預防宣導融入外籍人士生活圈、擴大國際司法合作面向、提高犯罪刑事責任、妥善保障外籍移工權益。
