隨著工業設計產業蓬勃發展,工業產品不再只重視其功能性,更注重其外觀設計。伴隨於此,專利客體亦由專利產品整體外觀,擴及至各部零件之設計。汽車作為日常生活常見的複合式產品,其維修利益龐大,故車廠傾向選擇就汽車之外觀零組件申請專利,除能排除其他競爭者外,亦能鞏固其於售後維修服務市場之地位,使消費者進行維修時僅能使用自家產品,賺取更多利益。我國汽車零組件產業多半從事售後維修服務市場,並於全球零組件市場中獨占鰲頭,年產值驚人。然,我國廠商帝寶公司就車燈產品被提起專利侵權訴訟後,引發國內相關產業恐慌,使我國開始探討設計專利適用維修免責條款之可能,希冀能對於設計專利為限制,保護國內產業以及保障消費者維修權

益。專利法賦予專利權人製造、販賣、使用等行為的排他權,為衡平公益及私益,有諸多就專利權限制的規定。美國法上維修與重建原則認為,若該修理行為屬於維修,為可允許維修;若該修理行為屬於重建,則為法所不允許,構成侵權。如何界定維修與重建之範圍,從而認定其行為的合法性至關重要。不僅我國探討維修免責條款,而欲於專利法中增訂第136條第3項,世界各國亦重視汽車外觀設計的維修議題,部分國家已通過維修免責相關法案。美國作為汽車生產大國之一,於西元2008年起相繼提出限制汽車外觀設計專利的零件法案,惟顧及國內產業利益考量均未通過。作為我國汽車零組件最主要之出口國且其專利法與我國相類,零件法案似能做為我國日後修法時

得參酌之規定。另外,導入維修免責條款影響過大,本文認為比起增訂維修免責條款,使設計專利得適用強制授權較能平衡專利權人保護及消費者權益,且為解決原廠有長期不製造或供不應求的情形,似可考慮恢復舊法第67條及68條未實施及未正當實施之規定。除能保障消費者維修權益,亦能避免單一立法之嫌並得適用於所有複合式產品。

隨著電動及智慧車輛的普及的,各式各樣的車載電子設備不斷演進,除了基本的電池、電能控制系統越來越有效率,駕駛輔助系統也不斷演化,使自動駕駛等級不斷提升,從Level 1 進步到 Level 4 逐漸往自駕車邁進。自駕車功能的實現,依賴大量不同功能感測器,光是高解析度相機一輛車可能要裝6-8 個不等,分別具備不同應用範圍及距離的功能。除此之外為提升安全性,不可避免的需安裝光達、雷達或相機,在感測器數量及種類越趨複雜情況下,感測器融合就成為自駕車識別環境最重要的一環,它將類似人類的眼睛、耳朵等效果可避開障礙物。在自動駕駛車輛與感測器結合相關論文有很多,先前文獻探討多以雷達、相機、慣性量測儀及全球定

位系統等感測器研究車輛定位或車速規劃等功能,較少利用光達及攝影機研究障礙物碰撞時間偵測,在現實世界中障礙物的場景非常複雜,如果行駛中車輛不能及時獲取與障礙物的碰撞時間,可能會發生事故。因此本論文會利用光達高精確度及測量距離長的優點,與相機感測器融合來達成車輛前方障礙物碰撞時間偵測,此研究首先利用 KITTI 公開數據集,設定所需模擬相機及光達感測器,使用感測器收集車輛前方障礙物數據,分別處理照片資料及點雲數據,針對照片資料須偵測其關鍵特徵,擷取並匹配前後照片關鍵特徵點,在照片辨識方面使用YOLO的深度學習演算法,實現可靠地識別照片中的車輛並在它們周圍放置一個界定框,對於光達資料則必須過濾並剪裁

所需部分,其後執行點雲資料分群,透過照片所鎖定的界定框及光達的分群資料,採用2D-3D傳換達成將光達與攝影機資料重疊達成融合的目地,車輛行進時系統可以鎖定前車物件界定框計算出與前車可能碰撞時間。模擬結果可顯示出結合光達及相機兩個感測器所獲得資料,即時計算出與前車碰撞時間,可完整融合相機及光達優點。
