消費金融商品為金融機構提供服務與各階層之消費者便利的資金需求的工具,讓消費者或消費資金的需求者,以便捷的交付工具或清算機制,與交易對象如百貨公司、網路通路商、各行各業提供商務或勞務的商業買賣交易行為等,均能透過銀行、買方、賣方三方交易之現代金融服務,無須提供擔保品,審核撥貸簡易,服務靈活快速,而達到經濟發展擴大內需與滿足個人家庭生活質量需求之金融服務工具。然而消費金融商品信用卡對消費者具有刺激消費與過度擴張信用之風險,過渡消費結果會使消費者負債提高,在收入不變或無法增加情況下,增加信用額度,而掉入循環信用之陷阱,永遠在支付孳息,而無法償還至消費本金。而外部經濟景氣環境與消費者內部因素,如失業

、疾病等,導致家庭或個人收入驟減,而有違約情形產生。進而有消費者為了甩債,且在公部門的監管下,施壓金融機構須作出公平待客原則,使得違約成本降低,而積極尋求方法與債權人協商等救濟行為。 本研究根據敍述性統計與文獻探討建立研究架構,研究方法以協商談判賽局理論之Nash均衡與零和 (Zero-sum)賽局模式分析與公部門地方法院協商裁定(IVA)及更生清算裁定(PAC)等公開資訊資料分析。而債權人與債務人的協商談判攻防,以囚徒困境、博奕理論或賽局理論為研究基礎,以消費金融商品之債權人與債務人兩造之協商談判結果分析,觀察四個象限賽局利益方法,由其中分配理論得知達成合意機率,並由研究架構中兩造相互影響,

進而由統計資料在假設驗證其結果之正確。本研究透過由公部門監管機構與司法部門之公開資訊,與個別銀行資料,去分析債務人申請協商方法、種類,協商成立與不成立等作深切之研究,並運用SCP管制理論使金融機構在消費金融商品市場及內部績效影響下之未來經營策略,作出修正建議。
