建立再生醫學適當之管理架構:以深入分析日本、美國及歐盟法為中心

再生醫學為一深具潛力之新興醫療領域,包括基因治療、細胞治療及組織工程等技術。由於近年來再生醫學技術的重大突破,世界諸國無不卯足全力發展再生醫學。然而,新興醫療技術的發展一方面為許多病患帶來一線曙光,另一方面亦引起包括人類受試者安全保障、難以確認其有效性、容易涉及生醫倫理爭議等諸多嶄新的挑戰。基此,一國如何藉由法律制度建立兼顧各方利益之再生醫學適當管理架構,乃一值得深入探討的議題。相較於日本、美國及歐盟已有較為完善之再生醫學管理制度,我國遲至2018年底始修正行政命令「特定醫療技術檢查檢驗醫療儀器施行或使用管理辦法」,以初步鬆綁對於再生醫學技術的實施限制;另一方面,與再生醫學產品息息相關之「再

生醫療製劑管理條例」卻自2019年初提出草案後即沒有後續進度。綜觀我國現況,實可謂尚未建立一成熟之再生醫學管理架構。有鑑於此,本論文旨在以質性訪談及比較法研究,為我國建立中之再生醫學管理架構提出具體建議。為達成前述目標,首先,本論文藉由文獻回顧,整理出一套針對生物醫學法律之研究及分析方法,即:從「規範主體」、「平衡『生物醫學倫理、受試者或病患之保護、未來患者之利益』等三個維度」、「管制強度」等三個面向進行綜合分析。接著,有鑑於我國建立中之管理機制大量參考日本法,故本文著重在詳細介紹日本之法律架構,並輔以美國及歐盟之制度,已提出複數可能之管理模式,再運用本論文建立之研究方法分析各國管理模式之利弊

。最後,本論文根據比較法研究及質性訪談之成果,針對整體政策規劃、再生醫學研究、再生醫學技術及再生醫學產品等四個面向提出具體且切合實務之立法或修法建議,以期能對於我國再生醫學法律規範之建構產生些許貢獻。

基因科技是時下最受矚目的新興科技,且以迅雷不及掩耳之勢發展著,近期科學家更發現一個較過去所使用之編輯技術,在使用操作上更為簡單、迅速、便宜且易於程式化的編輯工具-CRISPR/Cas9,將人們對於基因編輯之想像,從理論研究層面推向廣泛的實務應用。基因編輯不但可以用於編輯體細胞,治療以往連醫生都束手無策的疾病,也可基於非醫療目的進行基因強化,若對生殖細胞及胚胎進行基因編輯,則可能出現「訂製寶寶」,技術發展的同時潛藏著嚴重的倫理問題,引發許多爭議。2018年中國發生震驚全世界的基因編輯嬰兒事件,不僅使基因編輯的倫理爭議再度受到關注,更迫切地需要社會進行廣泛的討論以取得共識。本文將擇取基因編輯所引

發的倫理爭議中,最主要的三個議題,進行深入討論,包括「優生學」、「基因強化」及「Playing God」。接著本文將分別檢視中國、美國、英國及德國對於基因編輯的規範模式,並與我國相關法規範進行比較與分析。隨著基因編輯技術日漸成熟,或許會令人們感到訝異的是,許多身心障礙者其實並不看好基因編輯的發展,甚至認為政府應禁止基因編輯之實施,特別是用於編輯生殖細胞及胚胎之基因。一方面,基因編輯可以治療疾病,促進身心障礙者健康權之保障,另一方面,基因編輯企圖消除特定基因,使帶有特定基因的身心障礙者,受到社會的歧視,則基因編輯對身心障礙者來說究竟是利大於弊,亦或幣大於利?本文將於前述基因編輯之一般性倫理爭議的

討論基礎上,進一步從身心障礙者之觀點分析基因編輯對身心障礙者權益之影響。本文研究的結果認為,現今社會的主流價值觀仍以「醫療模式」來解讀身心障礙之概念,或許正因為如此,而催生了基因編輯技術,然觀體細胞基因編輯之實施,多出於身心障礙者自身的決定,且不具遺傳性,應為健康權所保障之範圍,然僅限於醫療目的之實施,應禁止基因強化,惟同時須強化身心障礙者之程序參與,包括人體試驗倫理委員會及再生醫療小組中納入身心障礙者代表,參與討論與決策的過程。相較於體細胞基因編輯,生殖細胞系基因編輯之實施,係由父母決定後代的生命態樣,不僅逾越生育權之範圍,更加深社會對於身心障礙者之歧視,縱認生殖細胞系基因編輯僅係提供身心障

礙者婦女一種生育選擇,然在社會主流價值觀的影響下,恐導致身心障礙者婦女必須被迫選擇實施生殖細胞系基因編輯,以避免帶有致病基因的孩子出生,反而侵害了身心障礙者婦女之生育自主權,故本文認為現階段應全面禁止生殖細胞系基因編輯之實施。惟在社會之身心障礙意識提升後,應可開放生殖細胞系基因編輯施用於因遺傳疾病而導致「不孕」之情形,以保障身心障者婦女之生育權。
